&&&&由人民网、中国法院网、新华网联合推出本周热点法治新闻，内容如下：&&&&&&&&十六届三中全会通过修宪建议&&&&&&&&10月11日至14日在北京举行的中国共产党第十六届中央委员会第三次全体会议，审议通过了《中共中央关于修改宪法部分内容的建议》并决定提交第十届全国人民代表大会常务委员会审议。全会认为，根据经济社会发展的客观要求，依照法定程序，把十六大确定的重大理论观点和重大方针政策写入宪法，有利于宪法更好地发挥国家根本法的作用。修改宪法必须坚持四项基本原则，立足我国国情，充分发扬民主，广泛听取各方面的意见，严格依法办事。另10月16日，国内各大媒体发布消息称中共中央曾于8月26日和28日在中南海先后召开党外人士座谈会，听取党外人士修宪意见建议。&&&&&&&&原乐山市副市长李玉书被执行死刑&&&&&&&&10月14日，根据最高人民法院下达的执行死刑命令，犯受贿罪和巨额财产来源不明罪的原四川省乐山市副市长李玉书被执行死刑。1996年至2001年，李玉书利用职务之便，索取和非法收受他人财物共计人民币893.89万元。此外，李玉书被依法扣押、冻结的财产中有人民币319.6万元、美元9.1万元不能说明合法来源。成都市中级人民法院日判处李玉书死刑，剥夺政治权利终身，并处没收个人全部财产。李玉书提出上诉，被四川省高级人民法院裁定驳回。&&&&&&&&在天安门前制造事端的两嫌疑人被捕&&&&&&&&北京市公安局10月17日对在天安门广场地区制造事端的叶国强、张理积两名犯罪嫌疑人依法逮捕，对16名在天安门广场地区实施不法行为人员依法治安拘留。10月1日10时许，43岁的北京市人叶国强因为个人无理要求没有得到满足跳入金水河，引起群众围观，造成现场秩序混乱。10月8日8时许，49岁的福州市人张理积驾驶一辆白色别克赛欧轿车，携带汽油、爆竹、烟花等，行至金水桥南侧时，突然向车外抛撒传单，并企图自焚烧毁车辆制造恶性事件，被执勤民警及时制止。北京市公安局负责人指出，采取极端方法和手段，扰乱社会秩序，危害公共安全，向政府施加压力，必须依法严肃处理。&&&&&&&&慕绥新第二批赃物18日开拍&&&&&&&&继今年2月份首批“慕马大案”涉案赃物被拍卖后，贪官慕绥新的第二批赃物，9大类、140余件贪官的收受的字画、名表、相机等物品于10月12日展示，10月18日拍卖。据透露，此次拍卖会标的评估起拍价为57万余元。不知是巧合还是特意安排，第二批慕绥新赃物的拍卖日期竟出人意料地定在了与慕马大案正式立案的日期。主办方负责人肯定通过展示、拍卖贪官赃物，必能对人们起到一定的警示和教育作用。&&&&&&&&福建首例治安防控保险获得赔偿&&&&&&&&盗抢案三个月未破案的，保险公司负责赔偿财产损失，这是福建石狮警方推出的一种治安防控措施，日前，被盗商户周建民获得保险公司支付的2500元赔偿金，他也成为首例获得赔偿者。积极探索以防范促打击的新路子，福建石狮警方从2001年起在繁华市区店面较多的地方实行“十店联防”，在企业较集中的地区实施区域协作“十厂联防”，通过构筑一条条“联防锁链”，使治安防范的触角遍及千厂万店。为巩固这一新的治安防控体系，这个派出所保安巡防中队主动为出资支持巡防工作的商户投保，并与市保险公司签订“特约保险协议”：保险公司根据巡防中队提供的保险对象名单，在其财产遭受入室盗窃、抢劫损失后，经公安机关立案3个月未破获的，保险公司负责赔偿被户的财产损失。&&&&&&&&广东公安公布23项便民措施&&&&&&&&广东警方10月13日向社会公布了全省公安机关23项便民利民新措施。今后，公民丢失身份证，马上可以申办新证，不再因报失三个月的限制而产生种种不便；九种出入境证件申办可通过打电话、上网、IC卡自助等多种方式进行，免除来回奔波之苦；双方对事实和责任无争议的轻微交通事故可得以简易程序处理，现场办结一切手续；一次性办理50张以上暂住证的工厂、企业，可以预约公安机关上门服务。&&&&&&&&缉毒英雄涉嫌贩毒在汉受审&&&&&&&&身为缉毒大队大队长，却因为贩毒而走上被告席。10月14日，在国内引起巨大影响的周鲲等6人涉嫌运输、贩卖毒品一案，在武汉铁路运输法院开庭，郑州铁路运输中级法院审理。37岁的周鲲，被捕前系贵州六盘水市水城县公安局缉毒大队大队长。他曾300多次深入毒穴，抓获毒贩无数，令毒贩们闻风丧胆，有人甚至扬言要花100万元买他的人头。因工作成绩突出，他曾荣获“全国优秀人民警察”、“全国先进工作者”、“全国禁毒先进个人”、“全国优秀青年卫士”等称号。今年1月30日，他因涉嫌运输、贩卖毒品，经武汉铁路运输检察院批准逮捕。&&&&&&&&“十一五”规划全球招标程序法律化&&&&&&&&国家发展与改革委员会(简称发改委)近日发布公告，面向海内外公开招标第十一个五年计划(简称“十一五”)规划前期研究课题。按照招标公告要求，中标的咨询机构一旦确定，发改委与中标者将签订合同，以法律形式约定双方的权利义务。这次发改委的招投标程序是自行制订的，从性质看，属于人为、主观的程序确定，但随着程序的逐渐成熟，就变成制度化的程序；而一旦以法律、法规形式固定下来，便成了法律程序。&&&&&&&&中国将严打拖欠克扣民工工资行为&&&&&&&&近日劳动和社会保障部、建设部联合发出《关于切实解决建筑业企业拖欠农民工工资问题的通知》。通知说，解决好拖欠农民工工资问题是保护农民工合法权益、维护社会稳定的大事，要严厉打击拖欠和克扣农民工工资行为。用人单位必须以法定货币形式按时足额支付劳动者工资，不得以任何名目拖欠和克扣。各级劳动保障部门和建设行政主管部门要定期监督检查。对恶意拖欠、克扣工资的企业，严格按国家有关规定进行处罚。&&&&&&&&遨游太空也有法律规范&&&&&&&&太空，在自然科学上的概念是空气空间以外的整个空间，在法律上的概念是国家主权范围以外的整个空间。调整各国在外层空间的活动中的关系的法律就是“外层空间法”。10月16日6时54分，中国首位航天英雄杨利伟自主出舱，我国首次载人航天飞行圆满成功！中国政法大学国际法学院副教授、中国空间法学会理事李居迁博士在接受记者采访时表示，从法律角度讲太空，是对我国首次载人航天成功的一种特殊庆祝方式。目前我国已经参加了有关空间开发的主要的国际公约和协议，但这些国际公约和协议恐怕不能直接作为国内的法律依据，需要从司法和立法上予以完善。&&&&&&&&
